The Scottish Office in January 2010 upheld a Planning Appeal by Mr Ewart Corrigan to build a Double Garage and Granny Flat Annex at 40 Lynedoch Road Scone Perth.
Planning permission had previously been granted in 2007 for a garage and store to replace an existing structure on site. However, despite the backing of the Planning Department and the Perth Quality Control Officer, local Perth Councillors rejected a planning Application for an ammendment to the permission, listening instead to several local objectors. These included John Lloyd an ex Perth Councillor who had served on the Perth Planning Committee.
After the refusal an appeal was lodged by Mr Corrigan with the Directorate for Planning and Environmental Appeals.
The reporter for the Scottish Directorate said in his decision letter:
"I have considered the public views of the development with particular care and struggle to identify a viewpoint for which the development would have an adverse impact, especially bearing in mind the 2007 permission."
He also added:
" I find that the proposals would not have a detrimental effect on the character and appearance of the area. The proposal would accord with that part of policy 71 of the Perth & Kinross local plan."
Referring to objections raised by local residents Mr John Crichton and Mrs Heather Patterson regarding overlooking and distance to their properties the reporter commented as follows:
" The gable wall is devoid of windows and therefore there are no overlooking issues."
" I consider that the distance is acceptable and would not adversely affect the living conditions by reason of overlooking"
Full Planning permission was therefore granted.
Despite the delay to the construction of almost 6 months caused by the objectors, the decision allows work to proceed on the double garage and Granny flat annex. Mr Corrigan senior, eighty nine years of age can now be cared for by his family.
A full copy of the Appeal Decision can by found at the Directorate for Planning and Environmental Appeals website
